I'm sure that it's at this moment that some of you are asking questions like "Dr. Sivana? Isn't he a DC character?"

To which I answer "Well, yes, BUT..."

"But what?" you may ask.

To which I say that once upon a time not long ago, someone I know pointed out a little website known as
Public Domain Super Heroes, a website full of comic book characters that are in the public domain, AKA characters that anybody can legally use.

At that time, I already knew I wanted to introduce a certain style of mad scientist character into the comic, so I decided why not search the site to see if I might be able to dig up something good. And what do you know, I find none other than Dr. Sivana himself.

Not the DC comics version, mind you, but THE original Fawcett Comics version of the character from back in the earliest days of comic books as we know them.

So I thought to myself "I'm planning to use a Dr. Sivana type character anyway, why not try using the original Dr. Sivana himself?"

Granted, I'll need to be careful to make sure I don't infringe on the DC version who's very much not in the public domain, but given that I've already managed to distinguish the two by making my version Dr. Otto L. Sivana instead of Dr. Thaddeus B. Sivana (as far as I can tell, the original Fawcett version of Dr. Sivana doesn't have a first name), I'd say I'm off to a good start avoiding stepping on DC's toes.

Bear in mind that this doesn't mean I have any plans of introducing Captain Marvel to the comic at any point in the foreseeable future. I'm not going to write off the idea entirely, but I wouldn't count on it. Besides, it'll probably help me to further distinguish him as being based on the Public Domain version if I avoid bringing his classic arch-nemesis along for the ride.
